Terms and Conditions

 

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the WopeDigital.com website (the “Service”) operated by WopeDigital Ltd. WopeDigital Ltd. provides products and services to help you get a world-class website.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. Any new features or tools which are added to the current service shall be also subject to these Terms and Conditions. WopeDigital Ltd. reserves the right to update and change the Terms by posting updates and changes to the WopeDigital.com website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you

 

Payment

Payment is made by the client for any of our packages in the respective currencies, in order to commence any of our website services. On confirmation of payment, a receipt will be issued based on the contact information we are provided with.

 

Supply of Information

The client is responsible for providing all necessary information in order to execute the website project. Such information includes logos, contact information, website content, images/videos, etc. Where there is any delay in providing necessary information, we reserve the right to delay commencement of the respective project until all information has been provided.

 

Changes/Corrections to Projects/Services

Website projects are up and running within approximately 5 working days. On the 3rd day of development, the client is given the opportunity to review and give feedback on his/her project.  However, any major deviations from initially agreed upon or unknown specifications will be charged at an hourly rate of $10/hour. This is separate from our provision of up to 1 hour of free website updates per month.

 

Names and Trademarks

Clients hereby grant WopeDigital a non-exclusive right to use Client’s trade names and logos as are used by Client’s hosted sites, including but not limited to screenshots of Client’s hosted sites, testimonials and associated photographs appearing on Client’s hosted sites (“Customer Public information and images”), in advertising and also on WopeDigital’s own websites describing and promoting WopeDigital’s Services.

 

Billing Policies and Cycles

All billing invoices and payment notifications will be sent to the client via email and SMS where possible. For all our products/services that have a recurring billing cycle, that cycle begins on the day the Client makes their first payment (the “Billing Date”) and is due on that day each month, or year thereafter, depending on the Service plan selected and billing terms for individual Services. Failure to make payment for services when due will lead to our inability to continue to provide the said service.

 

Domain Ownership and Transfer

The Client is the owner of their domain name at all times and WopeDigital Ltd. is proud not to hold our customers to ransom regarding their domain names. A Client may choose to transfer their domain name at any time and for any reason. Circumstances under which a domain name transfer request cannot be honoured include:

– Evidence of fraud regarding the domain name, it’s acquisition or use
– Dispute over the identify and authority of the person requesting the domain transfer
– Expiry of domain name due to a failure on the Client’s part to make payment for the required billing cycle on schedule
– Domain name is within the 60-day initial registration period with WopeDigital Ltd.
– Domain name is within the 60-day period from a previous transfer to WopeDigital Ltd.

 

Termination of Service

WopeDigital’s Service will continue in effect until Client validly terminates the Service

  1. The Client may cancel his/her service at anytime by emailing sales@wopedigital.com and then following the specific instructions indicated to the Client in WopeDigital’s response
  2. The Client upon cancellation of service will not be entitled to any refund of any fees
  3. The Client’s website will be taken offline
  4. Fraud: Without limiting any other remedies, WopeDigital may suspend a Client’s website if we suspect that the Client (by conviction, settlement, insurance or escrow investigation, or otherwise) has engaged in fraudulent activity or illegality in connection with the site or services or are in violation of the terms and conditions.

 

Prohibited Practices

Client’s may not utilize the Service to provide, sell or offer to sell the following: replicas; controlled substances; illegal drugs and drug contraband; weapons; pirated materials; instructions on making, assembling or obtaining illegal goods or weapons to attack others; information used to violate the copyright(s) of, violate the trademark(s) of or to destroy others’ intellectual property or information; information used to illegally harm any people or animals; pornography, nudity, sexual products, programs or services; escort services or other content deemed adult related.

 

Changes to Services and Pricing

WopeDigital reserves the right at any time, and from time to time, to modify or discontinue, the Service or any part thereof with or without notice. WopeDigital will not be liable to the Client or any third party for any modification, price change, suspension or discontinuance of the Service.
